Definitions: “We” and “us” means Europe Travel Centre Pty Limited (ABN 20 105 145 944).

“You or Your “means any user of this Website and any person who acquires any Travel Products from us.

“Booking & Advisory Services” means services provided by us to you in assisting you to acquire a Travel Product from a Third Party Travel Provider and includes advisory and consulting services, making this Website and any software associated with it available to you, and providing a facility to enter into transactions with us and Third Party Travel Providers (whose details and Travel Products appear on this Website).

“Third Party Travel Provider” means the company that provides you with the Travel Product on terms and conditions agreed with you.

“Travel Product” means the service or product provided by a Third Party Travel Provider, for example, an airline, hotel, cruise operator, car rental or similar providers of travel products.

“Website” means this website.

Third Party Travel Providers & Products: We act as a Booking Agent and sell Travel Products on behalf of accommodation, transport and other service providers such as airlines, rail, car rental companies, coach and cruise line operators. We are not a travel provider and, whilst we exercise care, we have no control over or liability for the services provided by the third party travel providers.

All bookings are subject to the Travel Provider’s Terms & Condition’s including conditions of carriage and limits on liability. Airlines, Cruise lines, Car Rental operators, Hotels are third party providers and there are numerous regulations in relation to advance purchase or other discounted airfares, which involve significant cancellation or amendment/re-issue fees and/or maybe non-refundable. You should read them before finalizing a transaction. We can provide their terms & condition’s as required, but it is your responsibility to be aware of the third party terms & conditions. Our service is to arrange and co-ordinate the service offered by third party services providers. We arrange a contractual relationship between you and the provider. We cannot guarantee the performance of the service providers. Any brochures provided by us are not ours but are supplied by the service providers and will include the third party terms & conditions. We accept no liability for errors in that material. Deposit, part or full payment by you will be deemed as acceptance by you of the travel providers terms & conditions and would also include any supplementary conditions applied by us.

The Travel Products offered by us are subject to availability and can be withdrawn without notice by the Third Party Travel Provider. Travel Products may also change at any time in accordance with the terms and conditions you agree with the Third Party Travel Provider.

Your Responsibilities: When making any booking, you must ensure you enter or advise details of each traveller correctly and according to the exact details as shown on his or her Passport or other identification document. Abbreviated names will not be acceptable for travel. Some Third Party Travel Providers will deny carriage if the traveller’s name varies from their booking and may cancel automatically if the traveller’s name is amended. We have no responsibility for any loss or damage arising from the incorrect entry of a traveller’s name or as a result of the Third Party Travel Provider’s policies. It is your responsibility to ensure all details of the booking are correct before proceeding and your responsibility to contact the Third Party Travel Provider prior to departure to ensure there is no late changes to the scheduled departure time of your flight. We will endeavour to update you on any changes that we are notified of in advance of your departure date from Australia. Most airlines offer only electronic confirmation of your reservation, or e-ticketing. We cannot be held responsible if your e-ticket does not arrive due to an incorrect email address or your junk email settings. You must notify us immediately if you do not receive your travel documents (E-tickets) due to a change of email address or contact telephone number after making a booking. It is your responsibility to review all travel documents and immediately advise us of any errors in names, dates or timings. You will NOT be permitted to travel if your e-ticket does not match exactly the name details as displayed on your Passport.

Obligations & Warrants: You warrant to us that: (a) you are at least 18 years old and have the power and authority to enter into a binding contract with us and have sufficient funds to pay for the travel services you acquire; (b) the information you provide us about yourself is true, accurate, current and complete (apart from any optional items) as required by any registration process; and (c) you will maintain and promptly update this information to keep it true, accurate and complete. (d) you have read the terms & conditions of all third party service providers and agree to be bound by those. (e) you are responsible for checking accuracy of all travel documents provided to you. (f) you warrant and acknowledge you have accessed the “Smarttraveller web site for any specific advice in relation to your intended destination. (g) Passport / Visa and other required travel identification documents are your responsibility. (h) you warrant to us that you have considered acquiring comprehensive travel insurance and we are not responsible for any failure by you to acquire adequate insurance cover.

The Website and links: We may at any time modify these terms and conditions and the changes will come into effect once they are uploaded onto this Website. You acknowledge and agree that your continued use of the Booking & Advisory Service is subject to the terms and conditions in force at the time of your use. You acknowledge that the inclusion of links on this Website is not intended as an endorsement or recommendation of any linked website or its content of such sites. We do not guarantee that this Website or any linked website will be free from viruses, or that this Website or any linked website will be uninterrupted. We reserve the right to correct any errors in rates or content as quoted on this site. All rates are subject to change. We will use our reasonable endeavours to notify you of such corrections.

Pricing: All pricing will generally be in Australian Dollars (AUD) and are subject to change, due to currency or other fluctuations. Please note extra ordinary charges such as Airfare taxes or other additional items for Car Rental bookings: i.e. Child Seats, GPS hire, Young or Additional driver fees, One Way hire surcharge or Port Charges for Cruises maybe quoted in the local foreign currency. All local currency amounts are generally paid directly to the service provider at the commencement of the service.

Cancellation Charges: Bookings cancelled after a confirmation Invoice has been issued will incur a cancellation charge and or maybe non-refundable. Any applicable cancellation charges will be advised at time of booking. N.B. Some Airfares or other travel products maybe non-refundable. Please refer to your Invoice for details. Travel Insurance is strongly recommended to cover any applicable cancellation charges subject to the Conditions of the Policy.

Refunds: Refunds are available subject to loss of deposit and any applicable cancellation charges as applied by Europe Travel Centre and Third Party Travel providers. Note: For many services such as Air Tickets maybe non-refundable or for car rental / leasing and motorhome rental, there is no refund of any unused rental days after the hire has commenced. Additional charges for Accessories: i.e. Child seats, picnic table/chairs, GPS hire, Young or Additional driver fees, Insurance excess and/or any other optional accessories are advised at time of booking and are non-refundable. Please refer to your Invoice for specific information on booking cancellation or amendment/re-issue charges.

Flight Changes / Reconfirmation: Please note it is your responsibility to re-confirm all flight departure times with the relevant airline prior to departure. Whilst we will endeavour to send e-mail notification of any changes to the original itinerary, we will not be liable for any costs incurred as a result of you missing a flight due to not having re-checked the itinerary prior to departure.

Travel Insurance: Travel Insurance is strongly recommended and in some cases is a mandatory requirement for travel. It should be taken out at time of booking to cover for loss of deposit or other applicable cancellation charges if you are unable to travel due to illness or an unforeseen circumstance subject to the Terms & Conditions of your Travel Insurance Policy. Travel Insurance is also recommended for Car Rental insurance excess charges when applied for damage or theft. Please contact Europe Travel Centre or your preferred Travel Insurance supplier for a Quote.

Pre-paid Car Rental/Car Leasing – Special Conditions: All costs for fuel, oil, motorway tolls, speeding or parking/traffic fines are not included or is damage to tyres or windscreens if not covered by the third party travel provider. These costs will be at your (Driver/Renters) own personal expense. N.B. Cross border driving restrictions may also apply. Please refer to your Invoice confirmation for details or contact us for further information on cross border travel.

GST Policy: GST is not applicable to international travel, however GST will be applied to any additional service fees that may be applied to a booking.

Payment Terms: We accept payment by cheque, online bank transfer, direct deposit to our bank account, Debit Cards or Credit Cards: Visa, MasterCard & American Express. Please note a surcharge may apply for Credit card payments. Please refer to your Invoice forspecific payment details. We take no responsibility if payments are  not received by the due date as shown on your Invoice.

Documents: Upon receipt of your final payment, the relevant travel documents will be issued and sent by e-mail or in some cases by post.

Frequent Flyer (FF) Points: It is your responsibility to notify us of any applicable Frequent Flyer membership details prior to your departure date ex: Australia. Please be aware some Airfares may not be eligible for Frequent Flyer rewards. We do not take any responsibility should an airline not receive your details. You should retain copies of your air ticket and boarding pass. Note: FF Points do not apply to Car Leasing or Car Rental products booked on this Website.

International Driving: A full current Australian/New Zealand driver’s licence is required when driving overseas and must be shown to the Car Rental company at commencement of your rental. An international driver’s licence may also be a requirement in some European countries. It is highly recommended to obtain an international driving permit prior to leaving Australia. Please contact your local Automobile Association for assistance.

Security Deposit: Generally for many services i.e: Hotels or Car Rental operators, they will require a security deposit by a recognised Credit Card to cover any possible additional charges not included on the pre-paid travel voucher for the Hotel Minibar or other optional accessories from Car Rental operators; i.e. Young or Additional drivers fees or One Way fees, GPS hire, child seats,additional rental days or Car Rental insurance excess in the event of accidental damage or theft. For car rental the security deposit is an amount blocked on your Card during the rental and is refunded or removed when the vehicle is returned, less any applicable charges.

Passports & Visa Requirements: A valid Passport with minimum 6 months validity from date of return and relevant Visas, including transit visas are your responsibility. All Visas must be obtained prior to travel. For more information check online at:

www.dfat.gov.au or www.smarttraveller.gov.au or with the respective Embassy or Consulate of each country that you are travelling to, as many destinations require visas for both Australian and non-Australian passport holders. For more information, log on to www.visalink.com.au. For travellers booked on flights to the United States, including Hawaii, it is now mandatory, under the Visa Waiver Program to receive an electronic authorisation known as ESTAA (Electronic System for Travel Authorisation) no less than 72 hours before travel to the USA. This can be obtained from https://esta.cbp.dhs.gov/esta/.

Vaccinations & Health: It is your responsibility to contact your Doctor regarding health requirements relevant to your travel itinerary, prior to travel. Vaccinations are strongly recommended for certain destinations.

Travel Advice: We recommend that you contact the Department of Foreign Affairs and Trade (DFAT) or visit their website www.smarttraveller.gov.au for general travel advice, as well as specific advice (including safety alert levels) relating to the destination you wish to visit. You can also register your travel plans with DFAT, so that you may be more easily contacted in an emergency.

Complaints Policy: Should a disagreement or dispute arise with us or a Third Party Travel Provider, all details must be submitted in writing to the attention of the Manager at the address shown on this web site within 30 days of your return travel to Australia. All correspondence will be acknowledged within 7 days and forwarded to the applicable Travel provider for investigation. We undertake to do all possible to provide a resolution to any complaints brought to our attention within a period not exceeding 90 days from date of receiving initial complaint.

General Disclaimer & Force Majeure: Whilst all care is taken to ensure all information contained is correct at time of printing or publication, we shall not be liable for any inaccuracies contained in any material provided to us by our third party providers. Europe Travel Centre Pty Limited and its employees shall not be liable to any person for any injury, damage, loss, delay, irregularity or expenses suffered as a result of any act of neglect, war, terrorism, acts of God of Force Majeure, severe weather or disaster, riots, strikes, epidemics,quarantine, medical, customs, visa regulations or dissatisfaction  with any service provided.

Governing Law: Use of this Website and all matters arising out of or in connection with it and all terms are governed by the laws applicable in the State of New South Wales. By accessing this Website, you consent and submit to the exclusive jurisdiction of the Courts of New South Wales in all matters arising out of or in connection with your use of this Website and terms.
